Terms of Service

Welcome to Thanklio. These Terms of Service ("Terms") govern your use of the Thanklio mobile application ("App," "Service," or "Application"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Thanklio, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Thanklio is a gratitude journaling application that allows users to:

• Create and store daily gratitude entries
• View and edit past gratitude entries
• Receive reminder notifications to practice gratitude
• Customize notification settings and preferences
• Use the app in English or Ukrainian

All data is stored locally on your device. We do not provide cloud storage or synchronization services.

3. User Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 years of age, you should use the App under the supervision of a parent or legal guardian.

4. User Responsibilities

When using Thanklio, you agree to:

• Use the App for its intended purpose of personal gratitude journaling
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App for any illegal or unauthorized purpose
• Maintain the security of your device and any backup credentials
• Be responsible for all content you create within the App

5. Intellectual Property Rights

App Ownership: Thanklio, including its design, features, and code, is owned by us and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain all rights to the gratitude entries and content you create within the App. Since all data is stored locally on your device, you have complete control over your content.

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

6. Privacy and Data

Your privacy is important to us. The text of your gratitude entries is stored exclusively on your device and is never transmitted to us. We do use Google Firebase for basic analytics, crash reporting, and app-version checks, which involves sending limited technical data (not your journal content) to Google's servers. 7. Disclaimers and Limitations of Liability

As-Is Service: The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Medical Advice: Thanklio is a journaling tool and is not intended to provide medical, psychological, or therapeutic advice. It should not be used as a substitute for professional mental health services.

Data Loss: While we strive to provide a reliable service, we are not responsible for any loss of data that may occur due to device failure, software bugs, or other technical issues. We strongly recommend backing up your device regularly.

Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

8. Notifications

The App uses local notifications to remind you to practice gratitude. You can control these notifications through the App settings or your device settings. Notifications are generated locally on your device and do not involve any external servers.

9. Updates and Modifications

App Updates: We may release updates to improve functionality, fix bugs, or add new features. You are encouraged to keep the App updated to the latest version.

Terms Updates: We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

You may stop using the App at any time by uninstalling it from your device. Uninstalling the App will delete all locally stored data. We reserve the right to discontinue the App or any features at any time without notice.

11. Third-Party Services

The App uses Google Firebase (Analytics, Crashlytics, and Remote Config) for app stability and usage insights, as described in our Privacy Policy. This and any other third-party libraries or frameworks used by the App are governed by their own terms and conditions. We are not responsible for any third-party services or their content.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiations. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Poland, without prejudice to any mandatory consumer-protection rights you may have under the laws of your country of residence.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede any prior agreements.

16. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
